DMCA Policy

Cylmoo respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Cylmoo will respond expeditiously to claims of copyright infringement committed using the Cylmoo service that are reported to Cylmoo's Designated Copyright Agent.

If you are a copyright owner, or authorized to act on behalf of one, and you believe that your work has been copied in a way that constitutes copyright infringement, please submit your claim via email to our Designated Copyright Agent at dmca@Cylmoo.com, with the subject line: "DMCA Takedown Request".

Required Information for DMCA Notices

Your DMCA notice must include the following information:

• Identification of the copyrighted work: A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed
• Identification of infringing material: Identification of the material that is claimed to be infringing and information reasonably sufficient to permit Cylmoo to locate the material
• Contact information: Your address, telephone number, and email address
• Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
• Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our Copyright Agent.

Required Information for Counter-Notifications

Your counter-notification must include:

• Your physical or electronic signature
• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Cylmoo may be found, and that you will accept service of process from the person who provided notification under DMCA 512 subsection (c)(1)(c) or an agent of such person

In accordance with the DMCA and other applicable law, Cylmoo has adopted a policy of terminating, in appropriate circumstances and at Cylmoo's sole discretion, users who are deemed to be repeat infringers. Cylmoo may also at its sole discretion limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Legal Consequences

• Making false claims of copyright infringement may result in liability for damages
• We reserve the right to forward DMCA notices to the Lumen Database (formerly Chilling Effects)
• We may publish redacted copies of legal notices we receive
• We may share your information with the alleged infringer in connection with processing your claim
